This Privacy Policy explains how Poke-Trade Holdings LLC., doing business as Poke-Trade ("Poke-Trade," "we," "us," or "our"), collects, uses, discloses, and protects personal information when you visit or use the Poke-Trade Shop, purchase products, create a Shop account, use Shop-related membership benefits, submit an offer or trade inquiry, contact us, or otherwise interact with our Shop services (collectively, the "Shop"). The Shop includes our storefront at poke-trade.com and any Shopify-powered storefront or checkout that we operate.
This policy applies to the Poke-Trade Shop and Shop-related transactions. A separate policy or supplemental notice may apply to marketplace listings, member-to-member trades, community features, insurance-related services, or other services outside the Shop.
1. Personal Information We Collect
"Personal information" means information that identifies, relates to, describes, or can reasonably be linked with an individual or household. The information we collect depends on how you use the Shop.
Information You Provide
- Contact and account information: name, email address, telephone number, billing and shipping address, account credentials, display name, and communication preferences.
- Order and transaction information: products viewed or purchased, cart contents, order history, discounts, membership tier or eligibility, delivery details, returns, refunds, disputes, and related communications.
- Payment information: payment card or other payment details are collected and processed by Shopify and our payment providers. We generally receive limited information such as payment status, payment method type, billing address, and transaction identifiers rather than full card numbers.
- Offer and trade information: product descriptions, photographs, declared condition or grade, ownership statements, requested price or trade value, shipping information, and communications related to a Best Offer, trade-in, or Shop trade request.
- Customer content and support information: product reviews, ratings, survey responses, messages, photographs, reports of incorrect product information, and other information you send to us.
- Marketing information: email or SMS subscription status, promotion entries, referral information, and marketing preferences.
Information Collected Automatically
When you use the Shop, we, Shopify, and our service providers may automatically collect device and usage information, including IP address, browser type, device identifiers, operating system, referring URLs, pages or products viewed, searches, cart activity, approximate location derived from IP address, interactions with emails or advertisements, and dates and times of access. We collect some of this information through cookies, pixels, software development kits, local storage, and similar technologies.
Information From Other Sources
We may receive personal information from:
- Shopify and payment, fraud-prevention, fulfillment, and shipping providers;
- Poke-Trade membership systems, solely as needed to verify account status, membership tier, and Shop discount eligibility;
- sales channels and platforms through which our products are listed or sold, such as eBay, TCGplayer, or TikTok Shop, when you transact with us through those services;
- analytics, advertising, and marketing partners;
- social networks when you interact with us or use a social sign-in feature; and
- publicly available sources and fraud or security databases.
2. How We Use Personal Information
We may use personal information to:
- operate, personalize, maintain, and improve the Shop;
- create and manage accounts and verify membership benefits;
- process payments, fulfill and deliver orders, provide tracking, and manage returns, refunds, disputes, and customer service;
- review Best Offers, trade-ins, and Shop trade requests, including evaluating ownership, identity, condition, authenticity, and estimated value;
- maintain product, inventory, pricing, availability, and market-reference information;
- send transactional messages and, with consent where required, marketing messages, product announcements, and drop alerts;
- measure Shop performance and understand how customers use the Shop;
- detect, investigate, and prevent fraud, abuse, security incidents, and unlawful activity;
- enforce our terms, policies, and agreements;
- comply with legal, tax, accounting, and regulatory obligations; and
- protect the rights, safety, and property of Poke-Trade, our customers, and others.
3. How We Disclose Personal Information
We may disclose personal information to the following categories of recipients:
- Commerce and technology providers: Shopify, hosting, cloud-storage, database, website, customer-support, and account-service providers.
- Payment and fraud providers: payment processors, financial institutions, identity-verification providers, and fraud-prevention services.
- Fulfillment providers: carriers, warehouses, suppliers, packaging providers, and other parties needed to fulfill and deliver an order.
- Professional advisers: lawyers, accountants, auditors, insurers, and consultants subject to appropriate confidentiality obligations.
- Analytics and advertising partners: providers that help us measure traffic, understand Shop performance, market our products, and show relevant advertising, subject to your choices and applicable law.
- Sales channels: third-party marketplaces or commerce platforms when needed to operate a listing or transaction initiated through that channel.
- Government authorities and other parties: when we believe disclosure is required by law or reasonably necessary to protect rights, prevent harm, investigate fraud, or respond to valid legal process.
- Business transaction recipients: actual or prospective buyers, investors, lenders, or advisers in connection with a merger, financing, reorganization, sale of assets, or similar transaction, subject to appropriate safeguards.
We do not disclose payment card information except as needed to process a payment, prevent fraud, comply with law, or resolve a transaction dispute.
4. Shopify and Other Third-Party Services
The Shop may be hosted or powered by Shopify. Shopify processes personal information to provide commerce, checkout, payment, security, analytics, and related services. Shopify may also process certain information for its own purposes as described in its Consumer Privacy Policy. Your use of Shop Pay or another provider's service may also be subject to that provider's separate privacy notice and terms.
Links to third-party sites, marketplaces, grading companies, price-data sources, social networks, or payment services are governed by the privacy practices of those third parties. We encourage you to review their notices before providing personal information.
5. Cookies, Analytics, and Advertising
We use necessary cookies to operate checkout, remember account and cart settings, prevent fraud, and secure the Shop. With consent where required, we may also use analytics, personalization, and advertising cookies or similar technologies.
You can manage available choices through our cookie banner and Privacy Choices page. Browser controls may also allow you to block or delete cookies, although doing so may prevent some Shop features from working correctly.
Sale or Sharing for Targeted Advertising
We do not sell personal information for money. Some disclosures of online identifiers and internet or device activity to advertising or analytics partners may be considered a "sale," "sharing," or use for targeted advertising under certain U.S. state privacy laws. Where applicable, you may opt out through our Privacy Choices page. Where required by law, we also process recognized browser-based opt-out preference signals, such as Global Privacy Control, for the browser and device sending the signal.
6. Marketing Communications
You may unsubscribe from promotional emails by using the unsubscribe link in the message. You may opt out of promotional text messages by replying STOP or following the instructions in the message. We may still send non-promotional communications about your account, order, payment, security, or requested customer service.
7. Retention
We retain personal information for as long as reasonably necessary to provide the Shop, fulfill the purposes described in this policy, maintain business and tax records, resolve disputes, enforce agreements, prevent fraud, and comply with law. Retention periods vary based on the type of information, the nature of our relationship, legal requirements, and operational needs. We may delete or deidentify information when it is no longer reasonably needed.
8. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no system, transmission, or storage method is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for notifying us promptly of suspected unauthorized use.
9. Your Privacy Rights
Depending on where you live and subject to legal exceptions, you may have the right to request access to, correction of, or deletion of personal information; obtain a portable copy; opt out of certain targeted advertising, sales, or sharing; limit certain uses of sensitive personal information; and appeal a decision regarding a privacy request.

This section supplements the rest of this policy for California residents. The categories below describe personal information we may have collected and disclosed for a business purpose during the preceding 12 months. We collect only the categories relevant to your interactions with the Shop.

We do not use or disclose sensitive personal information to infer characteristics about you. We do not knowingly sell or share the personal information of consumers under 16. Membership prices and discounts are based on the purchased membership tier or a promotion and are not offered in exchange for personal information. If we introduce a program that qualifies as a financial incentive under California law, we will provide the required notice and obtain consent before enrollment.
11. Children and Minors
The Shop is a general-audience commerce service and is not directed to children under 13. Children under 13 may not create an account, place an order, submit an offer or trade request, or provide personal information to us. Users between 13 and the age of legal majority may use the Shop only with the involvement and permission of a parent or legal guardian. If you believe a child has provided personal information to us in violation of this section, contact us so we can review and delete it as appropriate.
12. International Users
We are based in the United States. If you access the Shop from another country, your information may be processed in the United States and other countries where our providers operate. Those countries may have data protection laws different from the laws where you live. Where required, we use legally recognized transfer mechanisms and safeguards.
