Terms of Service

These Terms of Service ("Terms") govern access to and use of the Poke-Trade Shop, including our storefront at poke-trade.com, any Shopify-powered storefront or checkout that we operate, Shop accounts, purchases, Best Offers, Shop trade-ins, and related Shop services (collectively, the "Shop"). The Shop is operated by [[LEGAL BUSINESS NAME]], doing business as Poke-Trade ("Poke-Trade," "we," "us," or "our").

By accessing the Shop, creating an account, submitting an order or offer, or otherwise using the Shop, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Shop.

1. Shop Scope

These Terms apply to products and transactions in which Poke-Trade is the seller, buyer, or trade-in recipient. Separate terms may apply to member-to-member marketplace listings, peer-to-peer trades, verified-trade services, memberships, community features, insurance-related services, or third-party sales channels. If supplemental terms conflict with these Terms, the supplemental terms control for the feature or transaction they address.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract to create an account, place an order, submit a Best Offer, or enter a trade-in transaction. A person under 18 may use the Shop only through a parent or legal guardian who reviews and accepts these Terms and is responsible for the transaction. The Shop is not directed to children under 13.

You may use the Shop only in compliance with applicable law. You may not use the Shop if you are subject to trade sanctions that prohibit the transaction or if we previously suspended you for fraud, abuse, or a material violation of these Terms.

3. Accounts

You agree to provide accurate, current, and complete information and keep it updated. You are responsible for safeguarding your credentials and for activity under your account. Notify us immediately at info@poke-trade.com if you suspect unauthorized access. We may require additional verification before accepting an order, offer, trade-in, refund, or account request.

4. Products, Images, and Condition

The Shop may offer raw cards, graded cards, sealed products, collectibles, storage and display products, accessories, made-to-order products, and other merchandise. Product availability is not guaranteed.

  • Unique items: When a listing identifies the pictured item as the exact item for sale, the photographs form part of the condition description. Lighting, displays, camera settings, protective cases, and image compression can affect appearance.
  • Stock images: Images marked or reasonably understood as stock or representative images illustrate the product type and may not show the exact unit shipped.
  • Raw cards: Any condition label is a good-faith opinion, not a guarantee that a grading company will assign a particular grade.
  • Graded items: A grade and label belong to the identified third-party grading company. We do not control that company's standards or guarantee future regrades, crossovers, registry treatment, or market value.
  • Sealed products: Factory packaging may have minor wear or variation unless a listing states otherwise. We do not guarantee the contents, pull rates, rarity, or value of randomly packaged products.
  • Made-to-order or special-order items: Production and fulfillment times may be longer and will be disclosed on the product page, at checkout, or in an order update.

Please review the full listing before purchasing. If a material listing error affects an order, contact us promptly so we can evaluate an appropriate correction, cancellation, return, replacement, or refund as required by our policies and applicable law.

5. Brand and Affiliation Notice

Poke-Trade is an independent collectibles retailer and trading platform. Unless a product listing expressly states otherwise, Poke-Trade is not sponsored by, endorsed by, or affiliated with The Pokémon Company, Nintendo, Game Freak, Creatures Inc., any grading company, marketplace, price guide, or other brand owner. Third-party names, characters, logos, card images, and trademarks belong to their respective owners and are used only as permitted to identify, describe, compare, resell, or discuss genuine products.

6. Market Price and Pricing Information

The Shop may display MSRP, Market Price, recent sales, price trends, or other reference values obtained from third-party data, public listings, completed sales, internal data, or automated calculations. These values are estimates for informational purposes only. They may be delayed, incomplete, incorrect, based on a different condition or variant, or change rapidly. They are not an appraisal, guarantee of value, investment advice, or promise that an item can be bought or sold at a displayed reference price.

"Our Price" is the Shop's current asking price before applicable discounts, taxes, shipping, duties, or other charges. The price and charges presented for confirmation at checkout control the transaction, subject to correction of obvious errors before acceptance. You are responsible for making your own purchasing and collecting decisions.

7. Orders and Acceptance

Your order is an offer to purchase. An automated acknowledgment confirms only that we received the order; it does not mean we accepted it. We accept an order when we send a shipment confirmation, make the product available for pickup, or otherwise expressly confirm acceptance. We may reject, cancel, or limit an order before acceptance for reasons including inventory errors, pricing or description errors, payment failure, suspected fraud, quantity limits, shipping restrictions, or legal requirements. If we cancel after capturing payment, we will refund the amount paid for the cancelled item.

Inventory may be synchronized across Poke-Trade and external sales channels. Rare or one-of-one items may sell elsewhere before systems update. If that occurs, we may cancel the unavailable item and issue a refund.

8. Payments, Taxes, and Charges

You authorize us and our payment providers to charge the payment method you select for the total shown at checkout and any additional amount you later expressly approve. You represent that you are authorized to use the payment method and that the billing information is accurate.

Prices are shown in the currency indicated by the Shop. Taxes, shipping, duties, customs charges, and other required fees may be added where applicable. You are responsible for import duties and charges not collected at checkout. Payment processing may be governed by additional terms of Shopify, Shop Pay, or another provider.

9. Membership Benefits and Discounts

Certain Shop pricing or benefits may be available to eligible Free, Pro, or Elite Poke-Trade members. Membership status may be maintained through Poke-Trade.com or another authorized membership system and transmitted to the Shop for verification. Shopify does not have to be the membership billing provider for a valid discount to be applied.

  • Benefits apply only while the qualifying membership is active and in good standing.
  • Benefits are personal, nontransferable, and limited to the member's account.
  • Exclusions, quantity limits, discount caps, and stacking restrictions may apply and will be disclosed with the offer or membership terms.
  • A discount will not apply retroactively unless required by law or expressly approved by us.
  • We may correct or reverse a benefit obtained through error, duplicate accounts, manipulation, resale abuse, or misrepresentation.

Paid memberships and recurring charges are governed by the Poke-Trade Membership Terms, including the price, billing frequency, renewal terms, trial terms, and cancellation method presented before enrollment. You may cancel an automatically renewing membership through the same medium used to enroll or through another easy online method we provide, as required by applicable law. Cancellation stops future renewals but does not automatically cancel an already accepted Shop order.

10. Best Offers

A Best Offer is a request to purchase a Shop item at a proposed price. It is not accepted unless we expressly accept it and payment is successfully authorized within the stated time. We may accept, reject, counter, or allow an offer to expire. Unless otherwise stated, inventory remains available to other customers until payment is completed. Market changes do not require us to accept an offer or preserve an expired price.

11. Shop Trade-Ins and Trades

When the Shop allows you to submit an item for purchase, trade-in, or exchange with Poke-Trade, your submission is an estimate request and not a binding agreement. A final offer may depend on inspection, authentication, ownership verification, condition, grade, completeness, current demand, and market conditions.

By submitting an item, you represent and warrant that:

  • you own the item and have the unrestricted right to transfer it;
  • the item is genuine and not stolen, counterfeit, altered without disclosure, or subject to a lien or claim;
  • your descriptions, photographs, grades, and condition statements are accurate;
  • you will package and ship the item in accordance with our instructions; and
  • the transaction complies with applicable law.

If inspection materially differs from the submission, we may revise or reject the offer. We will disclose available return or disposition options before completing a rejected transaction. Any trade credit is nontransferable and has no cash value except where our written offer or applicable law states otherwise. Peer-to-peer trades are governed by separate Trade Center terms and are not covered by this section.

12. Shipping, Delivery, and Pickup

Shipping and delivery estimates are not guarantees. Delays may result from carrier operations, severe weather, holidays, customs, address errors, inventory reconciliation, fraud review, or events outside our reasonable control. Please provide a secure, accurate delivery address and inspect tracking updates.

Ownership and risk of loss pass as provided by applicable law. Nothing in these Terms limits rights you cannot waive under applicable consumer law. If tracking shows loss, damage, or delivery to an incorrect location, contact us promptly and keep all packaging. We may require photographs, a carrier claim, an affidavit, identity verification, or other reasonable documentation to investigate. Additional details appear in our Shipping Policy.

13. Returns, Cancellations, and Refunds

Eligibility, deadlines, item-condition requirements, excluded items, return authorization procedures, shipping responsibility, and refund timing are described in our Refund and Return Policy, which is incorporated into these Terms. Some products, including opened sealed products, personalized or made-to-order items, final-sale items, gift cards, and items whose protective seal or certification has been altered, may be nonreturnable where permitted by law and when disclosed before purchase.

We may refuse a return that does not match the item shipped, has been altered, is missing components, shows undisclosed use or damage, or appears fraudulent. We do not limit any return, refund, replacement, cancellation, or warranty right that applicable law makes nonwaivable.

14. Promotions, Codes, and Gift Cards

Promotions and discount codes may be subject to eligibility requirements, dates, exclusions, caps, quantity limits, and non-stacking rules. Unless stated otherwise, promotions cannot be applied to prior purchases or redeemed for cash. We may cancel or correct a promotion affected by fraud, abuse, technical error, or unauthorized distribution. Gift cards are governed by the terms presented at purchase and applicable unclaimed-property and gift-card laws.

15. Reviews and Customer Content

If you submit a review, photograph, report, suggestion, or other content, you retain ownership of your content but grant Poke-Trade a worldwide, nonexclusive, royalty-free license to host, reproduce, display, format, and use it to operate, improve, support, and promote the Shop. This license ends when the content is deleted from our systems, except for backups, content already used in permitted materials, or retention required by law.

You represent that you have the necessary rights to submit the content and that it is accurate, lawful, and does not infringe another person's rights. We may remove content that is fraudulent, abusive, irrelevant, unlawful, misleading, or inconsistent with our policies. We are not required to publish any submission.

16. Acceptable Use

You may not:

  • use the Shop for fraud, money laundering, trafficking in stolen or counterfeit goods, or other unlawful activity;
  • submit false payment, identity, ownership, condition, grade, or shipping information;
  • circumvent purchase limits, discounts, account restrictions, security measures, or access controls;
  • interfere with checkout, inventory, pricing, market-data, or fraud-prevention systems;
  • use bots, scraping, or automated access that burdens the Shop or violates posted instructions, except with our written permission;
  • introduce malware, attempt unauthorized access, probe security, or disrupt the Shop;
  • copy, resell, or commercially exploit Shop content or data except as permitted by law or written agreement; or
  • harass others, submit unlawful content, or infringe intellectual-property, privacy, or publicity rights.

17. Intellectual Property

The Shop software, design, layout, original text, Poke-Trade branding, logos, graphics, and other original materials are owned by or licensed to Poke-Trade and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Shop for personal shopping and collecting purposes.

Third-party product names, card images, characters, trademarks, grading marks, and other materials remain the property of their respective owners. No license to third-party intellectual property is granted except as necessary to view the Shop and identify products offered for lawful resale.

To report suspected infringement, contact with your contact information, identification of the protected work or mark, the material at issue and its location, a good-faith statement, and proof that you are the owner or authorized representative.

18. Third-Party Services and Links

The Shop may link to or integrate services operated by Shopify, payment providers, carriers, marketplaces, grading companies, price-data providers, social networks, or other third parties. We do not control and are not responsible for their independent services, availability, content, policies, or actions. Your use of a third-party service may be governed by separate terms and privacy policies.

19. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SHOP AND ITS CONTENT, MARKET DATA, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." POKE-TRADE DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT A WARRANTY CANNOT LAWFULLY BE DISCLAIMED. WE DO NOT WARRANT THAT THE SHOP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT MARKET-REFERENCE DATA WILL BE ACCURATE, CURRENT, OR COMPLETE.

THIS SECTION DOES NOT LIMIT AN EXPRESS PRODUCT WARRANTY WE PROVIDE IN WRITING, A MANUFACTURER WARRANTY THAT APPLIES TO A PRODUCT, OR ANY NONWAIVABLE CONSUMER RIGHT.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKE-TRADE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST BUSINESS, OR CHANGES IN COLLECTIBLE VALUE, ARISING FROM OR RELATED TO THE SHOP OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM A PRODUCT OR SHOP TRANSACTION WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID POKE-TRADE FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM OR (B) $100. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR PERSONAL INJURY CAUSED BY NEGLIGENCE WHERE APPLICABLE LAW PROHIBITS THE LIMITATION.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Poke-Trade and its owners, officers, employees, contractors, and agents from third-party claims, damages, liabilities, losses, and reasonable costs arising from your unlawful use of the Shop, your breach of these Terms, your customer content, or an item you submit for trade or sale. This section does not require you to indemnify a party for its own fraud, willful misconduct, or negligence to the extent prohibited by law.

22. Suspension and Termination

We may restrict or suspend access to protect the Shop, users, or third parties; investigate suspected fraud or security incidents; comply with law; or address a material breach of these Terms. Where reasonably practicable, we will provide notice and an opportunity to resolve the issue. Termination does not eliminate payment obligations, accepted orders, accrued rights, or provisions that by their nature should survive.

23. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except that mandatory consumer laws of your place of residence may also apply. Before filing a claim, you and Poke-Trade agree to make a good-faith effort for at least 30 days to resolve the dispute by contacting the other party with a written description of the issue and requested resolution.

Unless applicable law permits or requires another location, any court action relating to these Terms or the Shop must be filed in the state or federal courts located in [[COUNTY]], California, and each party consents to personal jurisdiction there. Nothing in this section prevents either party from seeking relief in an eligible small-claims court or reporting a matter to a government agency.

24. General Terms

These Terms and incorporated policies are the entire agreement regarding the Shop subject matter. If a provision is unenforceable, it will be enforced to the maximum extent allowed and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a merger, reorganization, sale of assets, or operation of the Shop. Headings are for convenience only. Electronic communications and records satisfy writing requirements to the extent permitted by law.

25. Changes to These Terms

We may update these Terms to reflect changes to the Shop, our practices, or applicable law. We will post the revised Terms and update the effective date. Material changes apply prospectively unless the law permits otherwise. Your continued use after the revised Terms take effect constitutes acceptance; however, the Terms in effect when we accepted an order generally govern that order.
